LCH SA Members Get Breathing Room on Short Margin
The SEC approved a rule change by LCH SA to create a Trade Registration Fund within its CDSClear operations, providing clearing members with margin forbearance to prevent automatic trade rejections when posted collateral is temporarily insufficient.
In the approval order, the SEC stated that the facility lets the clearing agency delay collecting additional collateral and register the trade. The member must transfer the additional collateral at the next collateral call, though LCH SA may demand it sooner. The pre-funded pool sits behind the forbearance and can be drawn on if the member defaults.
LCH SA restructured the €10 million minimum Default Fund contribution so that at least €7 million goes to the Default Fund and at least €3 million funds the Trade Registration Fund. Contributions for active members are scaled to their trailing 180-day peak usage and capped at €30 million, while members that have not used the facility in the prior 90 days pay only the €3 million minimum.
LCH SA also introduced an unfunded second layer of forbearance called "Credit Tolerance" for members that exhaust their allowance. Both facilities operate on a first-in-time basis for intraday trades, and while usage is disclosed in standard margin reporting, LCH SA does not disclose the maximum value of the Credit Tolerance to members.
Additionally, LCH SA amended its Counterparty Credit Risk Policy to set daily usage limits and a group cap tied to internal credit scores. The amendments also move relevant counterparties, including certain dormant non-U.S. members, to a rolling 12-month credit review cycle. They set minimum internal credit scores for two categories of RepoClear sponsored participants, including Guaranteed Sponsored Members. They also expand risk exposure calculations for Guaranteeing Agents to include the stress losses of the members they guarantee.
