Treasury Regulatory Agenda Outlines FinCEN, OCC Rulemaking Plans

The Treasury regulatory agenda outlined rulemakings that FinCEN and the OCC have issued or plan to complete over 2026 and 2027, including AML program overhauls, stablecoin issuer compliance, and bank capital rules.

FinCEN issued a new notice of proposed rulemaking, published April 10, 2026, revising AML and countering-the-financing-of-terrorism ("AML/CFT") program requirements for financial institutions. It supersedes a July 2024 proposal that FinCEN formally withdrew on April 7, 2026. FinCEN also plans to reissue a joint proposal with the SEC on customer identification programs for registered investment advisers and exempt reporting advisers in September 2026, replacing a May 2024 proposal. Additionally, FinCEN intends to propose revised customer due diligence rules implementing the Corporate Transparency Act by March 2027.

FinCEN and OFAC jointly issued a proposal on April 10, 2026, implementing the GENIUS Act's directive to treat permitted payment stablecoin issuers as financial institutions under the Bank Secrecy Act and requiring AML/CFT and sanctions compliance programs. A related joint proposal from FinCEN, the OCC, the Federal Reserve Board, the FDIC, and the National Credit Union Administration would require permitted payment stablecoin issuers to maintain a customer identification program. The agenda projected that proposal for July 2026. That target has passed and the agenda does not record it as issued.

The OCC is also weighing two joint proposals it had projected for July 2026: one with the FDIC on extensions of credit to insiders and transactions with affiliates and one with the Federal Reserve and FDIC on risk-based capital rules for banking organizations outside Categories I and II. The agenda does not record either as issued. The OCC additionally plans an interim final rule rescinding regulations to conform with Executive Order 14219 ("Ensuring Lawful Governance and Implementing the President's 'Department of Government Efficiency' Deregulatory Initiative"), which the agenda projected for the same month.
