CFTC Staff Warns DCMs Against Over-Broad Filings for Event Contracts

The CFTC Division of Market Oversight warned designated contract markets against self-certifying broad, template event contracts that bundle multiple permutations with differing settlement sources.

The Division said bundling numerous contract permutations under one broad certification prevents staff from evaluating each contract's compliance with core principles and denies market participants critical product information. Instead, designated contract markets listing a series or class of closely related event contracts must file for class self-certification under CFTC Rule 40.2 or seek CFTC approval under CFTC Rule 40.3.

To qualify for class self-certification: (i) each contract in the class must reference a prior, specific contract already certified or approved; (ii) all contracts must share an identical pricing source, formula, procedure, and methodology for calculating reference prices and payment obligations; and (iii) all contracts must use an identical currency. The Division gave qualifying examples, such as tournament outcomes governed by identical rules or single-ballot election results.

This advisory follows an earlier March 2026 Division letter warning that overly broad contract specifications could impair a designated contract market's ability to explain and analyze compliance. The Division clarified that nothing in the new guidance bars use of the CFTC's consolidated submission functionality to file shared supporting documents for related contracts, as long as each contract is still certified individually or as a class.

Where a self-certification proves inadequate, the Division warned it may stay the contract's listing or require withdrawal and resubmission of individual contracts for review.
