CFTC Extends Comment Period on 24/7 Trading and Energy Perpetual Contracts

Stephan Ariyan Commentary by Stephan Ariyan

The CFTC extended the comment deadline on its request for comment on extending standard futures to 24/7 trading and on perpetual contracts referencing physically delivered or storable energy commodities, moving it from July 27, 2026, to August 26, 2026 (see prior coverage).

The CFTC also added a request for comment on the self-certified 24/7 oil contract that NYMEX listed on July 8, 2026, and that the CFTC stayed on July 9, 2026 (see prior coverage).

Commentary

The CFTC's decision to extend the comment period on 24/7 trading and perpetual energy contracts signals that the debate has moved beyond innovation and into questions of market integrity and operational reality. By specifically seeking comment on CME's stayed 24/7 WTI contract, weekend price formation risks, and the industry's readiness to support continuous trading, the CFTC appears focused on whether round-the-clock futures markets can maintain reliable price discovery when the underlying physical crude oil market remains largely inactive. The additional questions suggest regulators are not yet convinced that existing surveillance, risk management, clearing, and commercial hedging infrastructures are prepared for a truly continuous energy trading environment.
