SEC Approves ICE Clear Credit Operational Risk Management Updates

The SEC approved ICE Clear Credit LLC's amended Operational Risk Management Framework, updating terminology, expanding coverage to Treasury clearing, and formalizing oversight roles for two governance committees.

The amendments consisted of terminology updates to ICC's operational risk lifecycle process labels, making explicit that each step addresses risk. For example, "Identify" became "Risk Identification" and "Mitigate" became "Risk Management." ICC also removed product-specific references to Credit Default Swap clearing from sections on external service provider assessments and technology control functions, reflecting ICC's expansion into U.S. Treasury securities clearing earlier in 2026 (see prior coverage).

On oversight, the amended framework expressly states that ICC's Operational Oversight Committee receives updates on information security metrics, certain remediation activity, and cyber and physical security incidents. The SEC found those changes consistent with Rule 17Ad-22 ("Standards for clearing agencies"), which requires covered clearing agencies to maintain governance agreements with clear and direct lines of responsibility.

Additional changes aligned the framework with ICC's separate outsourcing procedures and with ICE, Inc.'s Enterprise Risk Management Policy by conforming terminology across documents.
